Welcome to OrderBuka (“OrderBuka”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the OrderBuka website, mobile application, and all related services (collectively, the “Platform”).

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Platform.

1. About OrderBuka

OrderBuka is an online marketplace that connects customers with independent restaurants and food vendors. Customers can browse menus, place orders, and make payments through the Platform.

OrderBuka facilitates orders and payments but does not prepare, package, or cook food unless expressly stated.

2. Eligibility

To use our Platform, you must:

  • Be at least 18 years old or use the Platform under the supervision of a parent or legal guardian.

  • Provide accurate and complete information when creating an account.

  • Keep your login credentials secure.

  • Be legally capable of entering into binding agreements.

You are responsible for all activities carried out through your account.

3. Customer Accounts

When creating an account, you agree to:

  • Provide truthful information.

  • Keep your contact details up to date.

  • Protect your password.

  • Notify us immediately if you suspect unauthorized access to your account.

OrderBuka reserves the right to suspend or terminate accounts containing false or misleading information.

4. Ordering Food

Customers may browse restaurant menus and place orders through the Platform.

By placing an order, you confirm that:

  • The information provided is accurate.

  • The delivery address is correct.

  • You intend to complete payment.

  • You understand that order acceptance is subject to restaurant availability.

Once an order has been confirmed by the restaurant, it may not be possible to modify or cancel it.

5. Pricing

Restaurants determine the prices displayed on their menus.

Prices may change without prior notice.

Applicable taxes, service fees, delivery charges, or promotional discounts will be displayed before payment confirmation.

6. Payments

Payments are processed securely through trusted payment partners.

OrderBuka does not store your full debit or credit card information.

An order is considered confirmed only after successful payment authorization.

7. Delivery

Delivery may be carried out by:

  • The restaurant,

  • OrderBuka delivery partners, or

  • Approved third-party logistics providers.

Estimated delivery times are provided for convenience only and may vary due to traffic, weather, restaurant preparation time, or other unforeseen circumstances.

OrderBuka cannot guarantee exact delivery times.

8. Restaurant Responsibilities

Restaurants using OrderBuka agree to:

  • Provide safe, hygienic, and lawful food.

  • Maintain accurate menus and pricing.

  • Prepare orders promptly.

  • Comply with all applicable food safety and business regulations.

  • Fulfill accepted orders professionally.

Restaurants are solely responsible for the quality, preparation, and safety of the food they provide.

9. Customer Responsibilities

Customers agree to:

  • Provide accurate delivery information.

  • Be available to receive deliveries.

  • Treat restaurant staff, riders, and customer support respectfully.

  • Use the Platform only for lawful purposes.

  • Avoid fraudulent or abusive activities.

10. Cancellations

Orders may only be cancelled before the restaurant begins preparation.

Once food preparation has commenced, cancellation may not be possible except where required by law or our Refund Policy.

11. Refunds

Refunds are governed by the OrderBuka Refund Policy.

Eligible refunds may include:

  • Duplicate payments

  • Failed payments

  • Restaurant inability to fulfill an order

  • Incorrect charges

  • Verified service failures

Refund approval is subject to investigation.

12. Promotions

OrderBuka may offer promotional discounts, coupons, or referral rewards.

We reserve the right to modify, suspend, or withdraw promotions at any time.

Promotions may not be exchanged for cash unless expressly stated.

13. User Content

Users may submit reviews, ratings, comments, or other content.

By submitting content, you grant OrderBuka a non-exclusive, royalty-free license to use, display, and publish such content in connection with operating the Platform.

Users must not post content that is:

  • False

  • Offensive

  • Defamatory

  • Fraudulent

  • Illegal

  • Infringing on another person’s rights

OrderBuka may remove content that violates these Terms.

14. Intellectual Property

All Platform content, including:

  • Logos

  • Branding

  • Software

  • Graphics

  • Text

  • Designs

  • Images

are owned by or licensed to OrderBuka and are protected by applicable intellectual property laws.

No content may be copied, reproduced, or distributed without prior written permission.

15. Prohibited Activities

Users must not:

  • Commit fraud.

  • Use stolen payment methods.

  • Create fake accounts.

  • Interfere with Platform operations.

  • Upload malicious software.

  • Attempt unauthorized access.

  • Impersonate another person or business.

  • Sell prohibited or illegal products through the Platform.

  • Abuse customer support personnel.

Violations may result in immediate suspension or permanent account termination.

16. Account Suspension

OrderBuka may suspend or permanently terminate any account that:

  • Violates these Terms.

  • Engages in fraudulent activity.

  • Provides false information.

  • Compromises Platform security.

  • Violates applicable laws.

17. Limitation of Liability

To the maximum extent permitted by law, OrderBuka shall not be liable for:

  • Delayed deliveries

  • Restaurant errors

  • Food quality issues

  • Allergic reactions

  • Business interruptions

  • Loss of profits

  • Indirect or consequential damages

Restaurants remain responsible for the preparation and quality of food they provide.

18. Indemnification

You agree to indemnify and hold harmless OrderBuka, its employees, directors, affiliates, and partners from any claims, damages, liabilities, costs, or expenses arising from:

  • Your misuse of the Platform.

  • Your breach of these Terms.

  • Your violation of any applicable law.

  • Your infringement of another person’s rights.

19. Privacy

Your use of OrderBuka is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

20. Changes to These Terms

We may update these Terms from time to time.

Revised Terms become effective once published on the Platform.

Your continued use of OrderBuka after updates constitutes acceptance of the revised Terms.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.

Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts in Nigeria unless otherwise resolved through our Dispute Resolution Policy.
